Terms and Conditions

Page title: Terms and Conditions · Shopify slug: terms-of-service
1. Scope
(1) These Terms and Conditions ("Terms") apply to every purchase made through the online shop at lurexo.com between the shop operator (hereinafter "LUREXO", "we", "us") and the purchaser (hereinafter "you", "Customer"). Our range of goods spans the home and garden categories.
(2) A consumer within the meaning of these Terms is any natural person who enters into a legal transaction for purposes that fall predominantly outside any trade, business or self-employed occupation. A commercial customer is any natural or legal person, or a legally capable partnership, acting in pursuit of their trade, business or profession at the time the contract is formed.
(3) Terms put forward by the Customer that contradict, depart from or supplement these Terms shall form part of the contract solely where we have given our express written agreement.
2. Contracting Party and Contact
The contract of sale is established between you and the operator of LUREXO. Complete legal details of the provider are published on our Legal Notice page.

3. Conclusion of Contract
(1) The presentation of home and garden goods in our online shop does not represent a legally binding offer; it is a non-binding invitation to browse and place an order.
(2) By clicking "Buy" / "Place order" / "Pay now", you submit a binding offer to purchase the goods contained in your basket.
(3) Receipt of your order and its acceptance occur simultaneously — you will receive confirmation immediately after submitting your order via an automatically generated email. The contract of sale becomes binding upon dispatch of that email.
(4) We archive the contract text and send it to you together with these Terms by email. The current version of these Terms is available at all times at lurexo.com/terms-of-service.
(5) Contracts are formed and conducted in the English language.
4. Prices and Shipping Costs
(1) All prices shown on this website are inclusive of the applicable statutory Value Added Tax. Any delivery fees are displayed separately during the checkout process.
(2) For orders destined for countries outside the European Union and the United Kingdom, additional customs duties, local taxes and other charges imposed by the destination country may apply, and these are the Customer's sole responsibility.
(3) Full particulars of delivery charges and estimated timeframes are set out on our Shipping & Payment page.
5. Payment Terms
(1) The following methods of payment are accepted: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay and bank transfer. We reserve the right to exclude particular payment options in individual cases.
(2) The full purchase amount becomes due upon formation of the contract.
(3) Where payment is made by credit card or through PayPal, your account is debited immediately upon completion of the order.
6. Delivery
(1) Goods are sent to the delivery address provided by the Customer. Applicable timeframes are shown clearly on the relevant product page and again at checkout.
(2) Should delivery remain impossible after three attempts, we are entitled to withdraw from the contract. Any payments already received will be returned to you without delay.
(3) Where delays stem from force majeure, the delivery period will be extended to a corresponding degree. We will notify you promptly in such cases.
7. Retention of Title
All goods dispatched remain the property of LUREXO until the full purchase price has been received.
8. Right of Cancellation for Consumers
Consumers are entitled to a statutory right of cancellation. Full cancellation information and the model cancellation form are provided on our Cancellation Policy & Returns page.
9. Warranty and Liability for Defects
(1) Statutory provisions on defect liability apply in full. For consumers, the limitation period for claims arising from product defects is two years from the date of delivery.
(2) For second-hand goods, the limitation period is one year from delivery.
(3) If a delivered item is defective, please get in touch at contact@lurexo.com.
10. Liability
(1) We accept unlimited liability in instances of intent and gross negligence, as well as within the framework of applicable consumer protection law.
(2) In cases of simple negligence, liability is confined to breaches of a material contractual obligation — one whose satisfaction is essential to the proper performance of the contract and upon which the Customer may reasonably depend. In such cases, the amount recoverable is limited to damage that was foreseeable and characteristic of this type of contract.
(3) Our liability for loss of life, bodily harm or injury to health remains unaffected by the above.
11. Dispute Resolution
(1) The European Commission maintains an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
(2) We are neither willing nor obliged to participate in dispute resolution before a consumer arbitration board.
12. Applicable Law and Jurisdiction
(1) All contractual matters are governed exclusively by the laws of England and Wales, with the UN Convention on Contracts for the International Sale of Goods expressly excluded. In relation to consumers, this governing law applies only to the extent that mandatory protections afforded by the law of their country of habitual residence are not thereby withdrawn.
(2) Where the Customer is a merchant, a body corporate under public law or a public-law special fund, the courts of our registered place of business shall have exclusive jurisdiction over any disputes arising from this contract.
13. Final Provisions
If any provision of these Terms is or becomes invalid or unenforceable, whether in whole or in part, the validity of all remaining provisions shall not be affected. The relevant statutory rule shall take the place of any void clause.
